1. AGREEMENT TO THESE TERMS

These Terms and Conditions govern your access to and use of the website at ai-cybertower.com (the Site), operated by Ai CyberTower, Inc., a Delaware C Corporation with its principal place of business in Miami, Florida. By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

2. INFORMATIONAL PURPOSE ONLY

The Site describes Ai CyberTower's on-premises and edge AI infrastructure concept, including configurations, capabilities and deployment scenarios that are under development or offered subject to agreement. Nothing on the Site is an offer, a commitment to supply, or a binding specification. Product descriptions, capacities, performance characteristics, components, images and renderings are illustrative and indicative only, are subject to change without notice, and may depict planned or representative configurations rather than shipping products. Any supply of hardware, software or services will be governed solely by a separate written agreement signed by Ai CyberTower, and in the event of a conflict that agreement prevails over anything stated on the Site. Statements on the Site about future products, availability, capabilities or plans are forward-looking and not guarantees.

3. PERMITTED USE

You may access the Site for lawful business and informational purposes. You agree not to use the Site in violation of any applicable law or regulation; attempt to gain unauthorised access to the Site, its servers, or any connected system; interfere with or disrupt the operation, integrity or security of the Site; use automated means to scrape, harvest or index the Site other than by conventional search-engine crawling; submit false, misleading or unlawful information, or information belonging to another person without authority; upload or transmit malicious code; or reproduce, republish or exploit the Site or its contents commercially without our prior written permission.

4. INTELLECTUAL PROPERTY

The Site and its contents, including text, graphics, product renderings, photographs, layout, design, and the Ai CyberTower name and logo, are owned by Ai CyberTower or its licensors and are protected by intellectual property laws. You may view the Site and print or download extracts for your own internal business reference. All other rights are reserved. No licence is granted by implication or otherwise. Third-party names, logos and trademarks appearing on the Site are the property of their respective owners, and their appearance does not imply endorsement or partnership unless expressly stated.

5. ENQUIRIES AND SUBMISSIONS

When you submit an enquiry or other information through the Site, you confirm that the information is accurate and that you are authorised to provide it. We handle information submitted through the Site in accordance with our Privacy Policy. Please do not send confidential or proprietary information through the Site. Information you submit through the Site is not treated as confidential and does not create any confidentiality obligation unless we have signed a separate confidentiality agreement with you. Submitting an enquiry does not create a contract, a reservation, or any obligation on us to respond, quote or supply.

6. AVAILABILITY OF THE SITE

We aim to keep the Site available but do not guarantee uninterrupted access. We may suspend, withdraw, modify or discontinue all or part of the Site at any time without notice, and we are not liable if the Site is unavailable for any period.

7. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, Ai CyberTower disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Site or its content is accurate, complete, current, reliable, secure or error-free. You are responsible for any decision you take in reliance on the Site, and for obtaining your own professional advice before making procurement, architectural or security decisions.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Ai CyberTower and its officers, directors, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, data, goodwill or anticipated savings, arising out of or in connection with your use of, or inability to use, the Site, whether based in contract, tort, negligence, strict liability or otherwise, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred United States dollars (US$100). Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

9. INDEMNIFICATION

You agree to indemnify and hold harmless Ai CyberTower and its officers, directors, employees and agents from any claim, liability, loss, damage, cost or expense (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.

10. THIRD-PARTY LINKS

The Site may contain links to third-party websites and resources. These are provided for convenience only. We do not control, endorse or accept responsibility for the content, products, services or practices of those third parties, and your use of them is at your own risk and subject to their terms.

11. PRIVACY

Your use of the Site is also governed by our Privacy Policy, which forms part of these Terms.

12. CHANGES TO THESE TERMS

We may revise these Terms at any time by posting an updated version on this page. The last updated date will reflect the most recent version. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. GOVERNING LAW AND JURISDICTION

These Terms and any dispute arising out of or in connection with them or the Site are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida, and waive any objection to venue in those courts.

14. GENERAL

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ai CyberTower regarding the Site. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
